Change to building permit requirements

As of June 4, 2026, a detached storage structure like a garage, shed or pole barn does not require a building permit. Any structure containing habitable space* (like a bedroom) however, still requires a building permit.

Building projects, regardless of the building permit requirement, are still subject to other permits, including floodplain, shoreline, and land use/zoning compliance. Environmental Health permitting also still applies.

Construction or development may not occur prior to issuance of a permit. Trade permits such as mechanical, electrical and plumbing are still required for these detached structures. The easiest way to apply for these permits is online at missoulacounty.build. Click here to learn more.

*"Habitable Space" shall have the meaning provided in the International Residential Code and means a space in a building designed or intended for living, sleeping, eating or cooking. Bathrooms, toilet rooms, closets, halls, storage areas, utility spaces and similar areas are not considered habitable space.
